Ademir Ismerim, OAB/BA 7.829) SENTENÇA Vistos etc. 1) RELATÓRIO O PARTIDO DA REPÚBLICA e ROZÁLIO SOUZA DA HORA, já qualificados na inicial, por intermédio de procuradores legalmente constituídos, ingressaram com AÇÃO DE INVESTIGAÇÃO JUDICIAL ELEITORAL em face de FRANCISCO DE ANDRADE FERREIRA e como assistentes litisconsorciais passivos, ANTONIO BISPO DA CRUZ FILHO e COLIGAÇÃO ‘SÃO FELIPE MAIS FORTE’ (PP, PT, PTB, PMDB, PSC, DEM, PTC, PSB, PRP, PSDB, PCdoB), já qualificados nos autos, aduzindo que os investigados utilizaram-se de doação de materiais de construção e outros bens para captar ilicitamente os votos dos eleitores, obtendo vitória, nas eleições de 2.012, por uma diferença de apenas 25 votos.
Alegam na inicial ter havido um grande derramamento de dinheiro e distribuição massiva de bens aos eleitores que, em troca das doações, deveriam prestar o compromisso de votar no candidato “Chiquinho”, primeiro acionado, assim como hastear a bandeira vermelha (cor representativa dos acionados), no telhado de suas residências. Os acionantes narram na inicial que os acionados chegavam à residência dos eleitores, diretamente ou por meio de correligionários, perguntando o que estavam precisando, oferecendo (e efetivamente entregavam) dinheiro e materiais de construção, sob a condição de que os eleitores votassem no candidato “Chiquinho Ferreira” e hasteassem a bandeira vermelha.
Narram os investigantes que os eleitores: a) LEIDE SALES SANTOS (em 29.09.2012); b) MARIA RITA COSTA DA CRUZ DE SOUZA; c) SUELI GONÇALVES DE ANDRADE (em 04.10.2012); d) FELIPE MOTA DA SILVA (em 27.09.2012); e) CRISPIM VILAS BOAS SANTOS (em agosto de 2.012); f) LUCILENE DA PAIXÃO DOS SANTOS (em agosto de 2.012); g) LUIS ANTONIO SILVA DOS SANTOS (em agosto de 2012); foram abordados tendo sido oferecido a eles dinheiro e/ou material de construção, e que na maioria das vezes os eleitores eram abordados por REINALDO FERREIRA e ICA FERREIRA, porém em algumas vezes teriam participado o próprio candidato a Prefeito, o candidato a Vice e a à época Vice-Prefeita. Informa a inicial que os fatos foram registrados por meio de filmagens (anexadas). Aduzem, outrossim, na exordial que a pequena diferença de 25 votos demonstra, de forma inequívoca, que as doações feitas pelos investigados interferiram demasiadamente no resultados das eleições.
Ressaltam que, por meio de correligionário, os acionados entregaram área na casa de eleitores no bairro URBIS, por meio de veículo a serviço do Município e que os beneficiários foram obrigados a hastear a bandeira vermelha em alusão aos acionados. Também diz a inicial que os acionados descarregaram na Rua das Candeias, av. ACM, outra quantidade de areia, na porta dos eleitores, utilizando-se de uma caçamba que presta serviços à Prefeitura do Município. Ademais, sustenta a inicial que o sr. ANTONIO JOÃO DIAS DE JESUS registrou, inclusive, por meio de fotografias, a entrega de areia na casa do sr. MANOEL, conhecido como “Nó Zego”, realizada por meio de caçamba que presta serviços ao Município, que estava inclusive repleta de adesivos dos partidos políticos. Diante disso, resumidamente, requereram: a) a cassação do registro de candidatura e/ou diploma, além da aplicação de multa no máximo legal, e aplicação da sanção de inelegibilidade pelo prazo de 08 anos. Juntaram documentos de fls. 30/51.
O investigado FRANCISCO ANDRADE FERREIRA, apresentou defesa às fls. 59/69, requerendo, preliminarmente, a inépcia da inicial por falta de enquadramento específico das condutas que, em tese, teria ele praticado. Sustenta a fragilidade e nulidade da prova produzida, pois não se sabe quando foi produzida, não foram juntadas as fotos em que se alegou na exordial e que nas mídias não há comprovação de qualquer ilícito. Impugna cada uma imputações dizendo que não houve sequer uma captação ilícita de voto, pugnando, assim, pela improcedência da exordial. A COLIGAÇÃO SÃO FELIPE MAIS FORTE apresentou defesa às fls. 73/93, requerendo, preliminarmente, a inépcia da inicial por falta de enquadramento específico das condutas que, em tese, teriam sido praticadas. Alega a fragilidade e nulidade da prova produzida, pois não se sabe quando foi produzida, não foram juntadas as fotos em que se alegou na exordial e que nas mídias não há comprovação de qualquer ilícito.
Diz ainda não ter havido nexo causal entre o veículo (JOE-2646) que teria descarregado areia durante a campanha eleitoral, em troca de votos, com os investigados, visto que tal veículo não pertence ao Município. Impugna as imputações realizadas na inicial e, no mérito, pleiteia a improcedência da ação. O investigado ANTONIO BISPO DA CRUZ FILHO, apresentou defesa às fls. 95/104, requerendo, preliminarmente, a inépcia da inicial por falta de enquadramento específico das condutas que, em tese, teriam sido praticadas. Defende a fragilidade e nulidade da prova produzida, pois não se sabe quando foi produzida, não foram juntadas as fotos em que se alegou na exordial e que nas mídias não há comprovação de qualquer ilícito. Impugna cada uma imputações dizendo que não houve sequer uma captação ilícita de voto, pugnando, assim, pela improcedência da exordial.
O MPE ofertou parecer às fls. 107/122, preconizando a realização de diligências. Às fls. 123/130, o MPE juntou cópia de solicitação de instauração de inquérito policial para apurar crimes que teriam ocorrido nos fatos narrados. Às fls. 131, foi proferido despacho mandando cumprir parte das diligências requeridas pelo MPE, e cumprida, às fls. 135/138. Foi requerido o andamento do feito conforme consta de fls. 146/148. Decisão de fls. 149/150 indeferiu a prova pericial, argumentando que as partes admitiram ser a prova testemunhal apta a demonstrar o teor da inicial e contestações, entendendo ser desnecessária a prova pericial, tendo designado audiência de instrução. Na mesma decisão também foi afastada a preliminar de inépcia da inicial. Às fls. 153 o MPE requereu a juntada de cópias dos Inquéritos Policiais que foram instaurados com a finalidade de apurar os crimes decorrentes de fatos noticiados nos autos. Cópias dos referidos Inquéritos Policiais/decisões às fls. 154/686. MP n. 2.200-2/2001 de Às fls. 692, este juízo manteve a decisão de fls. 149/150, concedeu às partes vistas dos autos pelo prazo de 05 dias em face dos documentos juntados. Manifestação dos acioados às fls. 698/699.
Instrução realizada às fls. 704/722 e 744/755. Decisão deste juízo às fls. 726/727 quanto à delimitação da instrução (provas) e designação de audiência. Nova decisão deste juízo quanto a pedido de diligências e intimação para apresentar alegações finais às fls. 746. Os investigantes ofereceram alegações finais às fls. 769/788, sustentando ter havido ilícitos eleitorais, com a comprovação de distribuição de dinheiro e bens aos eleitores, seja por provas documentais ou mesmo pelo depoimento das testemunhas, tendo havido captação ilícita de votos e abuso de poder econômico. Bem por isso, pugnaram pelo não acolhimento das preliminares suscitadas pelos acionados, assim como, no mérito, a procedência da ação, com a cassação dos diplomas dos acionados e como consequências dos seus respectivos mandatos, para diplomar e empossar o segundo colocado nas eleições municipais de 2.012. Os acionados FRANCISCO DE ANDRADE FERREIRA e ANTÔNIO BISPO DA CRUZ, por sua vez, ofertaram alegações finais às fls. 789/806, sustentando que os acionantes não se desincumbiram do ônus de provar os fatos narrados na inicial, que as provas constantes dos autos se mostraram frágeis e que, portanto, deve ser julgada a demanda improcedente.
O MPE se manifestou às fls. 808/823 se posicionando pela improcedência dos pedidos constantes da inicial por falta de provas. Em síntese, é o relatório. Passo a decidir. 2) FUNDAMENTAÇÃO Inicialmente cumpre anotar que o abuso de poder econômico, sinteticamente, pode ser conceituado como a conduta que, abusivamente, se utiliza de recursos financeiros, de ordem pública ou privada, assim como do acesso a bens ou serviços em razão do exercício de cargo público, tendo potencialidade para gerar desequilíbrio entre os candidatos e, portanto, afetando a normalidade e legitimidade do pleito eleitoral. Por sua vez, o abuso do poder político ocorre quando o detentor do poder vale de sua posição para agir com a finalidade de influenciar o eleitor, em detrimento da liberdade de voto. Assim, trata-se de um ato de autoridade exercido em detrimento do voto. Por outro lado, a captação ilícita de sufrágio resta configurado, segundo a definição legal (artigo 41- A, da Lei 9.504/97) quando “(…) o candidato doar, oferecer, prometer, ou entregar, ao eleitor, com o fim de obter-lhe o voto, bem ou vantagem pessoal de qualquer natureza, inclusive emprego ou função pública, desde o registro da candidatura até o dia da eleição (…)”. In casu, tem-se que não restou comprovado que os investigados tenham, efetivamente, praticado alguma das condutas que a eles foram imputadas na exordial.
Os documentos trazidos aos autos, especialmente os de fls. 38/51, dão conta da declaração de eleitores quanto a possíveis distribuições de materiais e de dinheiro, em troca de votos e da possível utilização de bens e serviços públicos em prol dos investigados. Analisando as mídias (fls. 48 e 138), mesmo que não periciadas, tem-se que: uma delas apresenta um caminhão branco, com uma bandeira vermelha, sendo impossível saber a quem pertence o aludido automóvel, pois não foi identificado. Em outra, aparece o caminhão de placa JOE-2646, descarregando areia em uma rua. Em outra, dois homens retirando de um caminhão material parecido com areia e colocando na rua, porém sem qualquer identificação do mencionado veículo. Em outro vídeo, tem-se um caminhão de placa JLC-2490, com homens discutindo, porém sem qualquer importância para os fatos narrados.
Em um outro vídeo (de cabeça para baixo), este último caminhão encontra-se estacionado em uma rua e não foi vislumbrada alguma irregularidade que fosse importante para os fatos. Noutra mídia, há um caminhão que foi dito estar com adesivos dos investigados, porém não possível identificar isso nos vídeos e nem mesmo identificar as placas do veículo. Por fim, em outro vídeo há apenas uma pessoa com uma bandeira na mão, sem qualquer importância para os fatos que ora se analisa. Convém ressaltar que o MPE investigou todos os fatos constantes destes autos e, ainda que se alegue que a competência não seria da primeira instância, tem-se que a competência é para o processo e julgamento da ação penal e, portanto, em havendo indícios de práticas delituosas nos autos, inevitavelmente seriam eles encaminhados ao tribunal competente para o processo e julgamento dos crimes. Ademais, a alegação de que não houve contraditório no Inquérito Policial não merece acolhida.
De fato, inexiste contraditório em inquérito policial e, outrossim, os acionantes não estavam sendo objeto de investigação. A testemunha RITA DA CONCEIÇÃO, às fls. 711, nada soube informar de relevante sobre os fatos narrados na inicial. A testemunha MILENA DOS REIS SANTANA, às fls. 710/711, inclusive disse que a pessoa de LEIDE SALES SANTOS (pessoa que os investigantes alegam que teria recebido dinheiro para votar nos investigados) tinha preferência pelo candidato ROZÁLIO (investigante). Quanto à pessoa de LEIDE SALES SANTOS (declarações de fls. 711/714), além do acima informado (de que tinha predileção pelo candidato ROZÁLIO), não obstante tenha dito que recebeu dinheiro, em troca de voto, foi ouvida sem compromisso, razão pela qual, as suas declarações devem ser vistas com reservas.
Como bem ressaltado pelo MPE, em parecer de fls. 808/823, constitui a declaração a mencionada eleitora, um fato isolado e que não se reveste da robustez necessária para provar o narrado na inicial e como consequência a cassação dos diplomas e mandatos dos investigados. Quanto à pessoa de SUELI GONÇALVES DE ANDRADE, foi ela ouvida como declarante (sem firmar compromisso), conforme consta das fls. 714/716, com imparcialidade prejudicada e, em que pese ter dito que recebeu dinheiro para colocar a bandeira dos investigados, suas declarações devem ser vistas com reservas. No mesmo sentido, quanto à pessoa de ANTONIO JOÃO DIAS DE JESUS, foi ele ouvido como declarante (sem firmar compromisso), conforme consta das fls. 717/719, com imparcialidade prejudicada e, em que pese ter dito que foi entregue uma caçamba de areia na casa da pessoa de Manoel, também disse que não ouviu ninguém dizer que a entrega do material era para compra de votos. Assim, por ser declaração, sem compromisso, suas afirmações devem ser vistas com reservas. Quanto à pessoa de CILDA MARY COSTA DOS SANTOS, foi ela ouvida como declarante (sem firmar compromisso), conforme consta das fls. 722/723, não sabendo ela nada informar sobre os fatos. Por sua vez, a pessoa de EDSON GONÇALVES DE ANDRADE, às fls. 748, disse ser fiel ao candidato ora investigante, tendo sido, portanto, ouvido como declarante (sem compromisso) e que disse ter recebido material de construção para votar em candidato a vereador, o que, por óbvio, nada tem a ver com a situação constante destes autos. A pessoa MANOEL RESENDE DE MORAIS, às fls. 751, também ouvida como declarante, disse não ter recebido nenhum dinheiro ou material de construção quanto ao pleito municipal de 2012. Disse sim, que recebeu areia, mas que ela foi cedida pelo seu genro de nome JORGE e que a areia foi transportada pelo cunhado de JORGE, de nome MIGUEL. A pessoa de REGINALDO SANTOS (fls. 753) foi inquirida como declarante e nada de relevante disse quanto aos fatos objeto de apuração.
No que tange ao veículo JOE-2646, importante destacar que às fls. 726/727 foi indeferido o pedido de ofício ao DETRAN/BA e TCM para informar a propriedade e a existência de contrato de prestação de serviços entre o proprietário do aludido veículo e o Município de São Felipe, tendo entendido o magistrado que isto apenas atrapalharia o desenrolar do feito, sendo mais prático que o Município de São Felipe, se fosse o caso, eventual contrato no que tange ao referido veículo. Foi, portanto, oficiado ao Município (fls. 823) acerca do proprietário do citado veículo, tendo sido o ofício respondido pelo Município, às fls. 757, no sentido de que não houve contrato de locação, nos anos de 2012 e 2013, quanto a veículo de placa JOE 2446 ou JOE 2646. Em relação às fotografias de fls. 730/739, de importante, cito apenas a de fls. 737, que se refere ao veiculo citado no parágrafo anterior (JOE-2646) que teria sido utilizado para distribuir areia a eleitores em troca de votos. Além da resposta do Município de que tal veículo não foi objeto de contratação pelo ente federativo, cumpre ressaltar também, que mesmo que o veículo estivesse sob a pose do Município, isto, de per si, não geraria maiores problemas. Haveria erro apenas nos adesivos colados, o que obviamente é vedado, porém, utilizando-se da boa prudência não seria razoável desconstituir pessoas legitimamente escolhidas pelo povo, pela simples cola um adesivo, inoportunamente. MP n. 2.200-2/2001 de Ressalte-se, apenas por preciosismo, que os veículos municipais (próprios ou locados) podem trabalhar durante o pleito eleitoral. Ademais, ressalte-se que e não se tolera é a utilização destes veículos em prol de algum candidato, com fins eleitorais ou mesmo em descompasso com a legislação em vigor. Assim, mostrar que o veículo “A” ou “B” descarregou areia no local “Y” ou “Z”, mesmo durante o período eleitoral, por si só, não tem o condão de provar que aquele veículo foi, efetivamente, utilizado para beneficiar algum candidato, que tinha finalidade eleitoreira.
Em outras palavras, provar a utilização do veículo durante o pleito eleitoral, sem mais elementos probatórios, apenas prova que o veículo estava sendo utilizado, e não que estava sendo utilizado em proveito de algum candidato ou fora dos padrões determinados pela Lei 9.504/97. Some-se a isso que a pessoa (MANOEL RESENDE MORAIS), em tese beneficiada, afirmou que não recebeu nenhum tipo de ajuda em decorrência do pleito eleitoral de 2012. Vê-se, portanto, que a maioria das provas foram construídas com base em declarações de pessoas que não estavam compromissadas em dizer a verdade e que, algumas delas, até tinham predileção pelo candidato ora investigante.
Desta maneira, as provas se mostram extremamente frágeis, sem a imprescindível robustez, não tendo o condão de embasar a cassação dos diplomas, bem como dos mandatos dos ora investigados. Corroborando toda a fundamentação explicitada neste decisum vale colacionar ementas de julgamentos proferidos pelos tribunais pátrios. Nesse sentido: TRE-PA-AIJE: 209388 PA-Recurso Eleitoral. Ação de Investigação Judicial Eleitoral. AIJE. Conduta vedada. Art. 22. LC 64/90 c/c art. 73, inciso I Lei n.º 9.504/97. Preliminares de inépcia da inicial rejeitadas. Utilização de veículo pertencente ao Governo do Estado em campanha eleitoral. Ausência de prova robusta à confirmação da prática do ilícito eleitoral. Ação julgada improcedente. 1. Se a Ação de Investigação Judicial Eleitoral, narra fatos que se amoldam ao art. 30- A da Lei das Eleicoes e, ao mesmo tempo, sob o enfoque específico do art. 22, da Lei Complementar n. 64/90, rejeita-se a preliminar de incompetência que pretende afastar da Corregedoria Regional Eleitoral, a competência para relatar e processar a ação.
